I have an 03' 6.0 that I need to get smogged. It is 100% legal at this point (not deleted) but I have a CEL for P0401 that won't stop coming back.

I've replaced the EGR valve, BPD EGR Cooler, Oil Cooler, intake gaskets, had turbo serviced, replaced the air intake duct and CCV hose, pressure tested the CAC, put in exhaust manifold gaskets, cleaned IAT2 sensor, checked and cleaned MAP sensor hose and port, EBP sensor just because...

The code still pops up.

If I get a SCT SF3 tuner or similar and download one of the programs to get rid of the CEL, will it raise a RED FLAG and fail smog? or will it go under the radar? What do you guys in CA do to pass smog with similar issues or if yours is deleted?

I have to plug into OBD and that's all I'm worried about.

Any help or suggestions are much appreciated!

Get forscan on a windows laptop and check for hidden codes, forscan is good at retrieving those.
Wiring in good shape? Take a close look at the pigtail, check as far back as you can. A plugged cat can cause this as well. You can try dropping the cat, clearing the code and see if it comes back.
