That sucks man. I've been in the same place. Unfortunately in TX the law is on the womans side. You need to get a lawyer now and start recording phone calls and such. Sounds like it's going to be messy and you need to be prepared as much as possible. If you don't have anything good on her then you might as well forget about getting full custody.

For one look up Paternal Kidnapping. If you are established as the father. You have equal rights to your son. You have the right to know where he is, if he is safe, if he is being properly cared for, the right to see your son, if she refuses this, then contact the local authorities. Paternity is established either through Birth Certificate or DNA Paternity Test. The first thing you need to be doing is getting off this site and finding a lawyer ASAP. Even though you are not married. You can still file for visitation and even custody if you choose to. She can also file for child support. So you need to get a lawyer, establish temporary custody order and visitation order. Whether or not the temporary custody order will be in your favor or not does not matter. The big thing is the temporary visitation order. This gives you grounds to contact the police when she fails to allow you to visit your son. Because then she will be in violation of a court order.
