Harris County SUCKS.....

This should amaze me but after living here over 15 years NOTHING the DA or Harris Co. cops do would surprise me anymore....

He was in the wrong. As a CHL holder I know the laws state you only use your weapon for self defense. If someone is running away then let them go, no point in shooting them unless they are an immediate threat to you or others or stealing your property.

AND they didn't prosecute the perp? REALLY?????

I'm a CHL and I was involved in a gun fight over my rig. They kept my gun for over a year. Face it Harris county SUCKS. Plain and simple.

I HAVE PERSONALLY DEALT WITH THIS ANTI GUN HARRIS COUNTY B_SH!T.

And for the record this has NOTHING to do with CHL. Texas LAW DOES allow you to shoot at a fleeing individual. Does this shooter fall into that - well that's for the lawyers to figure out but if he has a good one he will skate like the perp did, just out more cash unfortunately.
Here is the law:

A person is
justified in using deadly force against another to protect land or
tangible, movable property:
(1) if he would be justified in using force against the
other under Section 9.41; and
(2) when and to the degree he reasonably believes the
deadly force is immediately necessary:
(A) to prevent the other's imminent commission of
arson, burglary, robbery, aggravated robbery, theft during the
nighttime, or criminal mischief during the nighttime; or
(B) to prevent the other who is fleeing
immediately after committing burglary, robbery, aggravated
robbery, or theft during the nighttime from escaping with the
property; and
(3) he reasonably believes that:
(A) the land or property cannot be protected or
recovered by any other means; or
(B) the use of force other than deadly force to
protect or recover the land or property would expose the actor or
another to a substantial risk of death or serious bodily injury.
