'Diesel Brothers' Being Sued by Environmental Group in Utah

A group of environmentally minded Utah doctors plans to bring legal action against local television personalities who, the doctors say, have made illegal modifications to diesel vehicles' pollution control systems.

Utah Physicians for a Health Environment announced Wednesday morning that they have notified four men known collectively as the Diesel Brothers that the environmental organization plans to sue if they do not stop removing pollution controls from trucks serviced at their Wasatch Front businesses.

Brian Moench, president of Utah Physicians for a Health Environment, said his organization has been aware since 2007 that some local auto shops specialize in defeating automobile emissions systems, he said.

"We got a number of complaints from citizens about 'coal rollers' — some of these people who do this to enjoy the notoriety of putting a big black cloud of smoke over other motorists and pedestrians," Moench said.

Moench said Utah Physicians has discovered online videos in which the Diesel Brothers — also featured on a Discovery Channel reality TV show of the same name — demonstrate what appear to be modified pollution control systems. The group, he said, also found videos in which the Diesel Brothers appear to demonstrate how diesel vehicles can be modified to bypass their emissions controls, and to advertise repair kits intended to facilitate these modifications.

Attempts to reach any of the Diesel Brothers for comment Wednesday were unsuccessful. In a December 2015 Facebook post, one of the Diesel Brothers said their videos were not about "rolling coal" — i.e., disabling emissions systems in order to produce a visible discharge of diesel smoke — and were not intended to irritate environmental regulators.

Moench said the Davis County Health Department later tested a vehicle modified by the Diesel Brothers and confirmed that it released significantly more pollution than an unmodified vehicle.

In a statement, Dennis Keith, manager of the Davis County Health Department's Air Quality Bureau, confirmed that the health department had tested a modified diesel vehicle, but was unaware of any intended lawsuit. The allegations made by Utah Physicians, he said, "are very concerning to the Davis County Health Department."

"Tampered vehicles can have a very harmful effect on our air," he said in the statement. "These tampered vehicles are illegal and should not pass a Davis County emission test."

However, Keith said the businesses named in the lawsuit weren't permitted to conduct emissions tests, and therefore fell outside the jurisdiction of the health department.

Diesel emissions include hazardous air pollutants, a subset of chemicals characterized by the Environmental Protection Agency as harmful to human health in relatively small quantities, that are associated with cancer, birth defects and neurological effects, Moench said. Additionally, he said, diesel vehicles are disproportionately large sources of more common pollutants such as nitrogen oxide and particles.

Moench said that even without modifications to bypass federally mandated emissions standards, diesel vehicles may be responsible for two-thirds of the particulate matter associated with transportation emissions in a given airshed. The majority of the soot released by diesel vehicles would be categorized as PM 2.5, the small particles notorious for building up under Utah's wintertime inversions, he said.

Utah Physicians is still working on an estimate of how many vehicles may have been modified by the Diesel Brothers. Moench said he believes the Diesel Brothers have been modifying diesel emissions systems at their Utah shops for about three years.

He said Utah Physicians seeks a cessation of the Diesel Brothers' activities, but would also like to see them issue some sort of recall on their work.

"We feel like they have a responsibility to undo what they have done," Moench said, "and that they should take back all the vehicles that they have modified and make them legal again."

it's honestly ridiculous. in any case, it is what it is. i'd think the MOST that
could happen is utah would pass some sort of smog action on diesels, even
though a safety inspection is all that's needed.

The MOST that could happen? Really? Remember the coal rolling retards that started really bringing attention to diesel owners over in New Jersey when they smoked out the wrong Prius? That started the movement that gave the EPA more ammo, which led to them coming to SEMA and cracking down on vendors for selling deletes and it's just gathered steam from there.....it's a snowball effect and each time people get busted rolling coal to the "wrong person" it just keeps getting worse and worse for the rest of us in the diesel performance game, let alone the industry.

I get it, some people make bad choices and we were all kids once, but people gotta realize that at least for now, this is a hot topic button with a lot of people until something else comes along to grab their attention. Technically, I do believe removing emissions equipment is a federal offense, not just state to state, so depending on how high up these "doctors" want to push it, they could get some big fines.

It's not good for all the rest of us, like Nighthawk said, the EPA is already watching.
And under this administration they already hate us and they'd like to ban performance parts all together

It just pee's me off when the tree love's think diesel smoke is polluting the air, as someone has pointed out, the "soot" is heavier, falls too the ground not suspended in the air.

The batteries running these eco friendly cars are more of a hazard than my 7.3L diesel:surprise:

Not totally related but....

I helped with a research study of applying sulfur to farm ground in the Midwest. Over the last 50 or so years sulfur usage has increased but the returns on investment have stayed the same or has a margin of diminishing returns higher then what it was say in the 1940s. What we found was that as auto plants and steel mills in the northeast "cleaned up" their act or closed down, there was less sulfur oxide in the air that was carried to Midwestern states, thus requiring more synthetic sulfur to be applied to soils, which in turn has increased sulfur "pollution" in groundwater by farmers over applying sulfur.

The whole study was INCONCLUSIVE because we didnt have proper data points and a few to many "suggestive persuasions", but we had some pretty sweet geothermal maps and air stream tracking maps that showed as the plants shut down air "radiation particles" (what we called sulfur oxide) went from a deep dense red/purple to a light yellow.

So sometimes "pollution" isnt what it seems least it depends on how you look at it.

Well you know how insane they are when they call carbon dioxide a pollutant or greenhouse gas. If I remember my biology lessons, every green plant uses it to make the oxygen we need for survival. But don't mess with the left's religion, they're sure that we're responsible for climate change (it can't have anything to do with magnetic north shifting and taking the jet stream with it, which in turn has altered our weather patterns) One big volcano spews more crap into the atmosphere then every combustion engine on the planet combined, yet somehow it's our trucks & suv's :doh:

Well I'm not for tree huggers in any way... but these guys should have done their homework before broadcasting on live television that they do egr deletes, stacks, etc. when they could have left that alone and just do it after the show is broadcasted.... But when they go as far as advertising the products themselves , well honestly they deserved to get popped for this one... can anyone say dumba$$es :rofl::rofl:

I have tons of other things i could be doing than watching their show for 45 minutes, but I get a kick out of how stupid they sound when they want to put military axles, nitrous and whatever else comes out of their crapshoot of a mouth...

...They should have never made it to Television.

I'm curious on how this recall will work because 99+% of the people who were deleted there knew exactly what they were getting done and not to mention the people from out of state who took their vehicles there and the other who moved/sold them.

Utah isn't California where they force you to get an emissions test done every year or 2.
