before i start i appologize for the long post.
ok heres the deal, saturday evening i was heading into san antonio with my girl friend, driving on i guess what you could call a back road (lower smithson valley rd). i was in my dads truck because mine is in the shop. as soon as i saw the cop i let out of the throttle and looked down and was doin a little over 60 on a road that i thought was 55. i couldnt believe she was pulling me over for 5 over. it turns out the speed limit is 40 and she claims to have clocked me doin 70!! my dad cleaned out the truck about a week ago when he looked at trading it in so i didnt have the insurance card. when she wrote me the ticket she gave me the wrong copy, it says in red "court copy" so i dont know what to do now, i dont know how much it will cost or even if they will try the case. at the bottom of the ticket it say "white- court. pink- officer. yellow- violator." has anyone had this happen to them? what do you think they will do? thanks |

Dont have any advice except call a lawer and ask. I got a speeding ticket in SC along with a friend of mine. The troper had the wrg vehicle listed with the wrg driver...that didnt matter....still had to pay the lawer 350.00.
I have been told, that if you go pay the ticket, pay $1 over and walk away... no reciept or change back. This way the ticket never goes anywhere further...the fine is paid, but its still an open ticket due to the overpayment. I STRESS.... this is to be done at YOUR RISK, as I was only told about this and have never tried it. |

since its 30 over i think i HAVE to go to court, and im 18 so i need to do defensive driving (if they allow it) my dad says i should try to fight it if i really wasnt doing 70 but i dont think that would do any good since i dont have any proof except my girl friend as a witness. i talked to an officer at school but he couldnt give me a straight answer since its a ticket from another county, but he said they might drop the case since they have the wrong copy of the ticket... could that really be true?

nope. the police here have printers in their cars so it looks like a receipt from a store.

Man you are in deep doodoo. 30 over in Ohio is a reckless opp and could cause a suspension. I have been told 20 over in Ohio the officer can take you're license on the spot. I don't know were you live but good luck.
