EGR delete and emissions

i have been contemplating deleting the egr when i do a flush and replace the oil cooler. i do have to run an emissions test where i live but its a joke. cost 10 bucks, drive through a jiffy lube style building, get out and they hook up to your OBD port and put a stick in your exhaust for a total of 15 seconds. i dont even have a cat on my exhaust and they still passed me this year. so i guess what im wondering is will it cause me to fail?? i have a early 04 and didnt think it would throw a code but didnt know if it would show up on their obd reading or what? i know this is a hot topic but thanks anyways
