I'm getting a dpf delete for my 08 250 and my question is, is how much of a deference is it to stay stock at the tail pipe rather than to go 5" flo pro (other than sound and price)

I was told 4" exhaust is same performance wise as 5", but the sound is better with 5". now, stock exhaust vs 4"? not too sure myself. the main thing is the DPF delete, which you are doing. if you can ditch the cat too, do it. after that, it's minor differences in power, slightly lower EGT's and maybe some throttle response.
that said, I went full on, with down pipe, 5" with muffler for the best of everything. I plan to keep this truck for a long time, so the extra $ now will make me happier in the long run. you gotta choose for you... |

Yeah thats what I was thinking I'm just worried about getting stoped and a cop seeing the 5" out the back and look a little further.

I have been hearing of people worrying about it, but not heard of it happening. most cops don't know or keep up on emissions laws. it's just not their domain and there's too many cars out there to keep up with.
I modded my truck before I even got the registration, then heard the DMV was going to do an inspection on it (I bought it in another state). my wife pointed out that the ladies at the DMV that would do the inspection would not know the difference. she was right. they looked at the vin and the door tag, that's it. don't stress it or you'll look suspicious when you get pulled over and get your truck searched for drugs.
