He seemed genuinely surprised to learn they had put the HPOP on, but he looked it up in the computer while I was on the phone with him. When he found it he told me he'd find out what was going on and give me a call back...

I'm going to give them a chance to do the right thing before I get fussy.

I call BS on that. The EPA would have a cow if that we really the case.

Sorry to hear you are going through all this. Even though don't seem like the brightest bunch, they seem to try to make it right.

diesels do tend to "seep" oil....a drop here...a drop there.....mainly from CAC seepage........BUT no modern motor should leak......that was only acceptable back in the days of cork gaskets...

Update:

Called the dealership this morning to get the update he promised to call me back with yesterday. Turns out they'll be replacing said gasket at no charge....

Thank you all for your help. The questions you raised helped me paint him into a corner where he had to admit the real problem, and thus that it was their issue to rectify on their dime.

Yep, can't ask for more.

Won't get it back until the middle of next week though. He said that all the area dealers are sending their diesel work to them because they don't have the techs for it? Anyway, now they have more work than they can do and are running behind.

So, it just occurred to me, this noise my motor was making could very well have been the HPOP starving for oil since the pan gasket around it was leaking.

Would this have damaged the pump in any way? Should I inist that it be replaced at the same time as they redo the gasket?!?

no.....the gasket that can leak externally is just a sealing gasket for the crankcase........ although the noise could have been the injectors starving for oil since the oil level was low......

just see how it sounds when you get it back..
